第一次座谈会

23年前的五一国际劳动节,也就是1986年的5月1日,对马来西亚摩托商总会是一个重要的日子。因为这一天是由雪兰莪摩多西卡商公会主催筹组全国性总会的第一次座谈会,假借雪兰莪华人行团总会会所举行。

出席座谈会的各州同业计有:

霹雳州太平:戴奇发,王合生,罗九,李炉招;

霹雳州安顺:郑志芳;

彭亨州关丹:陈锦祥,李卓骏;

彭亨州文德甲:黎景全;

柔佛州麻坡:陈添发;沈玉金;

出席的各州同业代表皆强烈反映了团结各州同业、组织具有更大代表性全国总会的意愿和诚意,以争取行业共同利益的必要性与重要性。座谈会由雪兰莪暨联邦直辖区摩托车商公会主席曾瑞粦主持。同业们一致决定在下一次座谈会成立筹委会,作为成立全国摩多西卡商总会的起步。

在当晚的雪兰莪暨联邦直辖区摩托车商公会庆祝8周年晚宴上,曾瑞粦正式宣布倡议筹组大马摩多西卡商总会或联合总会。

其实,早在1982年期间,雪兰莪暨联邦直辖区摩托车商公会出席由南洋商报主催的座谈会上曾经提出组织总会之初议。出席座谈会的理事成员计有:曾瑞粦,关德民,陈俊明,马光德,李锦侠等人。他们表达了希望全马各州电单车代理商积极组织本身公会,续而由各州连成一线,组成全国性总会。但是当时时机尚未成熟,只是个人谈论而已。

借重研讨会一举成功

雪兰莪暨联邦直辖区摩托车商公会身为筹组总会的原动力,经过多次讨论及筹备,终于1986年12月7日(127)的星期天,在吉隆坡的总统酒店成功举办一项有史以来的全国性“摩多西卡行业的困境与展望”研讨会。举办研讨会的目的除了使同业深入了解因种种环境造成的困难外,更重要是如何集思广益,寻求突破,使到摩多西卡行业有更美好前景。身为研讨会工委会主席的黄锋,也是雪兰莪暨联邦直辖区摩托车商公会秘书长,强调研讨会的另一个重大目的是讨论成立全国摩多西卡商公会,以期全国各地同业能够团结在一个旗帜下,共同维护及争取同业应享有的合理权益。之前,黄锋接受南洋商报专访提及在争取同业利益时,经常面对力量不足的问题。 在争取销售商利益时,有关当局便曾以“没有总会,代表性不足”的理由而不作全面考虑。 当时只有雪兰莪及霹雳州有摩多西卡商公会的成立。有了总会,便有足够的力量和代表性去争取摩多西卡销售商的利益。

黄锋主讲“成立全国摩多西卡商公会的重要性”

以“成立全国摩多西卡商公会的重要性”为讲题,黄锋语重心长说出同业的心声,阐述摩托车代理商面对种种困境和难题,包括行业性和业务方面。由于没有一个全国性的代表组织,往往被政府忽略,尤其遭到各州陆路交通局不同政策和不同措施的诸多刁难,甚至经常朝令夕改,使到我们各州同业无所适从,吃尽苦头。在业务上也困难重重,面对制造装配厂商和总经销开出许多苛刻的条件,为了生意和三餐温饱,在百般无奈的情况下,勉强接受代理合约。

成立筹委会

在127研讨会上,来自各州两百多位同业一致认同有筹组总会的迫切性,即席推选及成立11人筹委会,获得授权进行注册总会一切事宜。筹委会以黄锋(直辖区)为首,担任筹委主席,副主席刘群(雪兰莪)、财政拿督黄志萍(森美兰)、秘书刘佑和(直辖区)、委员;林明云(柔佛)、黄国铸(彭亨)、曾瑞粦(直辖区)、谢金溪(槟城)、陈添财(马六甲)、郑志芳(吡叻)及陈春贵(沙巴)。

由於成立全国性的行业团体总会,社团注册官规定至少需要有7个州级团体的支持和成为总会的属会会员,而当时只有2个州成立以摩多西卡代理商为大多数会员组成的公会,即雪兰莪暨联邦直辖区摩托车商公会和吡叻摩多西卡商公会,因此,在现实环境下,筹委会议决先招收个人或公司会员,另一方面则积极推动及鼓励各州同业尽快组织摩多西卡商公会。

社团注册官批准总会章程及成立

经过两年时间,总会於1989年1月31日获得社团注册官批准成立,章程宗旨包括促进会员的联系与谅解及维护同业权益;探讨对会员代理商的商业影响及作出建议;探讨与报告对电单车业务影响的法律,争取对有关法律进行修订及举办各类促进电单车行业利益发展的活动。续而成立了第一届理事会,由黄锋担任会长,陈添财担任署理会长,副会长为陈金福与郑志芳,总务刘佑和,副总务关友国,财政刘群,副财政李春贵,福利方春榜,副福利李高山,交际吴清和与苏水,查账黄国铸与萧绪旺,理事林明云、许绍如、谢金汉、吴成兴、黄德兴与张建生。

协助各州成立公会

90年代初,随着多个州相续成立摩多西卡商公会,包括槟州,新山及彭亨公会等,总会决定通过修改章程,接纳公会/团体会员,有关修改章程,於1993年1月14日获得社团注册局正式批准,不久,共有8个州及区域级的公会纷纷加入,成为总会的公会会员。

截至2004年6月14日,总会共有9个公会会员,那就是雪兰莪暨联邦直辖区电单车商公会、槟州电单车商公会、吡叻电单车商公会、森美兰自由车摩多汽车电器商会、马六甲车商公会、昔加末电单车商公会、柔佛新山摩多商公会、彭亨州摩多同业公会及吉坡电单车汽车商暨银业公会。

在总会长准拿督黄锋的领导下,总会的会务迅速发展,对摩托车业的贡献,获得全国同业的认同。较后又有6个州及区域级的同业公会加入总会,它们是麻属电单车商公会、砂拉越中区车商公会、古晋自由车摩托商公会、峇株吧辖自由车摩托商会、居銮汽车摩多商公会及吉玻摩托车商公会。目前,总会总共有15个属会,它们拥有的会员总计逾5千名。

确立属会的地位重要性

在会务发展及组织的扩大的过程中,会务的重点及力量逐渐由个人或公司会员转向公会或团体会员,总会认为有必要进一步确定各州及各区公会的地位与重要性,因此决定再次修改章程,把原来一个会员一票的制度改以属会的区域组织为标准。在2007年8月17日获社团注册官批准的新章程下,在保留了个人或公司会员地位之余,同时修订了公会或团体会员推选总会代表的制度,以属会区域范围大小作标准,即区域级公会 (如昔加末、新山等) 2位代表;州级公会(如吡叻、槟城等)4位代表;联合州级公会 (如雪直及吉玻) 8位代表。

根据国际主流

此外,跟随国际主流,尤其是13亿人口的中国对摩多西卡或电单车的称呼,在2007年11月18日召开的第9届理事会(2006-2008)的第5次理事会会议上,一致通过把马来西亚电单车商总会改名为马来西亚摩托车商总会。其实,在2001年6月3日,总会为使摩哆西卡的称呼更中文化,让中台商人更易了解,总会曾决定将马来西亚摩托西卡商总会改为电单车商总会。由此证明,总会对内关心及维护会员的权益,对外侧重发展摩托工业并与国际接轨。


The first gathering

The International Workers’ Day of 1986 was a historic day to the MMSDA. On this date, a gathering was held for the first time by the Selangor Motorcycles Dealers Association to discuss the setting up of a national organization of the motorcycles dealers association. The landmark meeting took place at the premises of the Federation of Selangor Chinese Guilds and Associations in Kuala Lumpur.

Present at the discussion session were trade representatives from Taiping and Teluk Anson of Perak, Kuatan and Mentakab of Pahang, Muar and Batu Pahat of Johore, Kota Baru of Kelantan, Penang, Federal Territory and Selangor.

Those present unanimously expressed the cogent need to have a national body with greater representation to strive for the common interest of the trade. The discussion was conducted by Mr Chan Soi Lin, President of the Selangor and F.T. Motorcycle and Scooter Dealers Association. Later in the same evening, at the 8th Anniversary Dinner of the association, Chan formally announced the proposal to set up a federation of motorcycles dealers association. It was agreed at the gathering that a pro-tem committee be formed at the next discussion session to prepare for the formation of the proposed federation association.

The idea to have a national body of the motorcycles dealers association was suggested as early as 1982 by the Selangor and F.T. Motorcycle and Scooter  Dealers Association at a forum organized by the Chinese newspaper Nanyang Siang Pau. Among the committee members present at the forum were: Chan Soi  Lin, Kuan Teck Min, Chen Jun Min, Ma Kong Teck and Lee Kim Hap. They expressed hope that motorcycles dealers of the various states would set up associations in their respective state to pave the way for the formation of the national body. However, time was not opportune at that juncture to set up the national body and the proposal was just left on the shelf.

MMSDA was formed after a Seminar

The Selangor and F.T. Motorcycle and Scooter Dealers Association had been a motivating force in the formation of the national body. After several discussions and much preparatory work, a seminar on the “Dilemma and Prospect of the Motorcycle Trade” was staged at the Kuala Lumpur Regent Hotel on 7th December 1986. It was at this seminar that the participants gained insight into the difficulties of the trade caused by social environment and participants also learnt the importance of making collective efforts to seek a breakthrough for the future of the motorcycle trade. The Secretary of the Selangor and F.T. Motorcycle and Scooter Dealers Association, Wee Hong, who was also the working committee chairman of the seminar, stressed at the seminar that another important objective of the gathering was to discuss the setting up of a national body of the motorcycles dealers association to unite all those in the country involved in the motorcycle trade to safeguard and strive for their legitimate rights and interests.

Earlier, in an interview with Chinese newspaper Nanyang Siang Pau on the issue of the motorcycle traders, Wee Hong said that motorcycles traders faced a big challenge in their bargaining power. He said that this was because at that time only the motorcycles traders in the Selangor and Perak states were organized in the form of trade association. He said that a national body, if there was one, would have greater bargaining power and  representation to fight for the interests of the motorcycle traders. Wee Hong pointed out that in the past, the authorities and other parties concerned had always refused to give full consideration to the motorcycle dealers’ request and demand on the ground that they were not organized and they did not have the power of representation.

Talking about the importance of a national body of the motorcycle dealers association, Wee Hong spoke the mind of the motorcycle traders. He talked at length on the dilemma and difficulties the motorcycles traders were in. He said that as the motorcycle traders were not represented by a national organization, their rights and interests had always been neglected by the government. This was particularly true at the state level, where the motorcycle traders were subjected to hardship as a result of the policy difference in the different states, Wee Hong added. He said that without a national body to represent them, motorcycles traders could only suffer in silence in the face of harsh dealership offered by the manufacturers and inappropriate government legislation.

Formation of Pro-tem Committee

It was at the seminar of 7th December 1986, which was attended by some 200 motorcycles traders from the various parts of the country, that an 11-member pro-tem committee was formed. The pro-tem committee, headed by Wee Hong, was given the mandate to apply for government registration of the proposed national organization. The other committee members were deputy chairman Low Kuan (Selangor), treasurer Wong Chee Ping (Negeri Sembilan), secretary Liu Yew Her (Federal Territory), and members Lim Ming Yun (Johor), Ng Geok Choo(Pahang), Chang Soi Lin (Federal Territory), Cheah Kim Kok (Penang), Tan  Tien Chye ,Chang Chee Fang (Perak), Tan Choon Kui(Sabah).

Government regulation at that time required that the formation of a national body of any association must be supported by at least 7 state associations as members of the national body. However, there were then only the Selangor and F.T. Motorcycle Dealers Association and the Perak Motorcycle Dealers Association. As a measure to overcome the problem, the pro-tem committee launched a campaign to encourage the motorcycles dealers to form the motorcycles dealers associations in their respective state.

ROC Approved Registration and Constitution of the MMSDA

On 31st January 1989, the Registrar of Societies approved the registration of the Malaysia Motorcycle and Scooter Dealers Association. Constitution of MMSDA, among other things, seeks to promote understanding and safeguard the interests of members, study and report on legislations that impact on the motorcycles trade, propose amendments to the legislations concerned, hold events and activities to develop interest of the motorcycles trade. The inaugural chairman of MMSDA was Mr Wee Hong.

Assisting the Formation of State Associations

Following the formation of motorcycles dealers association in several states or areas, including Penang, Johor Baru and Pahang in the early 1990s, the MMSDA decided to amend its constitution in order to accept association members. Soon after the amendments were approved by the ROC on 14th January 1993, some 8 state associations and area associations became members of MMSDA.

As of 14th June 2004, there were 9 member associations under the MMSDA. They were the Selangor and Federal Territory Motorcycle and Scooters Dealers Association, the Persatuan Peniaga-Peniaga Pulau Pinang, the Persatuan Penjual Motosikal Perak,the Persatuan Peniaga-Peniaga Basikal,Motosikal,Motorcar & Alatan Letrik Negeri Sembilan, the Persatuan Perniagaan Kenderaan Melaka, the Persatuan Peniaga Motosikal Segamat Johor, the Persatuan Penjual-Penjual Motosikal & Skutar Johor Bahru, the Persatuan Peniaga-Peniaga Motosikal Negeri Pahang, the Persatuan Peniaga-Peniaga Kenderaan Bermotor Kereta Terpakai & Kewangan Motor Kedah & Perlis.

Under the stewardship of Wee Hong, MMSDA develops rapdly. The contribution MMSDA to the motorcycles trade had won recognition of all members. Later another 6 state associations and area associations joined the MMSDA. They were the Persatuan Peniaga Motosikal & Alat-Alat Ganti Daerah  Muar, the Sarawak Central Region Bicycle & Motor Traders Association, Sarawak, the Kuching Bicycle & Motor Traders Association ,the Batu Pahat Cycle & Motor Dealers Guild, the Persatuan Peniaga-Peniaga Kereta Motor Kluang, Johor, and the Persatuan Peniaga-Peniaga Motosikal Negeri Kedah.. Presently there are 15 member associations under MMSDA with a total membership of more than 5,000.

The Status of the Member Associations under MMSDA

In the course of development, MMSDA has placed greater emphasis on member associations  than on the individual members or company members in terms of voting right. MMSDA thus decided to amend its constitution once again to change the existing “one member one vote” system to a system where the number of votes for a member association is determined by the size of the region or area covered by the association. The constitution amendments were approved by the authorities on 17th August 2007.  Under the amended constitution, an area association (such as the Segamat Association, the Johor Baru Association) will have 2 delegates, and a state association (such as the Perak state Association, Penang state Association) will have 4 delegates, and joint state association (such as the Kedah  & Perlis Association, the Selangor and Federal Territory Association) will have 8 delegates.

In Keeping with International Norm

For consistency sake, a committee meeting of the MMSDA on 18th November 2007 unanimously resolved to replace the Chinese words dian dan che (electrical bicycle) as used in the Chinese name of the MMSDA with the words mo tuo che, a term used in mainland China to mean motorcycle. The last time MMSDA made changes to its name was on 3rd June 2001, when it substituted the words mo tuo xi ka with the words with dian dan che so that the name of MMSDA can be more easily understood by the Taiwan Chinese as well as Chinese in mainland China.
